Understanding DUI Charges in California
Most people think of drunk driving when they hear "DUI." Driving under the influence is, however, driving with an impaired ability to safely operate your vehicle due to:
- Alcohol intoxication
- Illegal drug use
- Prescribed medications such as painkillers
- Or even over-the-counter drugs, such as allergy medications
California’s Blood Alcohol Concentration (BAC) Limit
The laws concerning this have established DUI standards, such as blood-alcohol concentration, or BAC. In California, the BAC is .08% or above. There are other tests that police can conduct.
While you must give your consent to be tested, California has an "implied consent" law, which means that when you get a driver's license, it assumes your agreement for testing if the officer stopping you has reasonable suspicion.
Therefore, if you do not consent to be tested, the penalties can often be much harsher than if you had taken the test and failed it. An attorney can ensure your rights are protected when it comes to breath & blood tests.

What Happens After a DUI Arrest?
- Arrest and Booking: After being pulled over and tested, if your BAC is over the legal limit or you refuse testing, the officer will arrest you for DUI. You’ll be booked at a local jail, fingerprinted, and held until you're released or bail is posted.
- Administrative License Suspension (DMV Process): The officer issues a pink temporary license, and you have 10 days to request a DMV hearing to challenge the suspension. If you don’t request the hearing or lose it, your driver’s license will be suspended.
- Criminal Court Process: You’ll be required to attend court, starting with an arraignment where you enter a plea. If you plead not guilty, your case continues through pre-trial hearings and possibly a trial.
- Sentencing (If Convicted or Plea Entered): Penalties for a first DUI typically include fines, license suspension, probation, DUI classes, and possibly jail. The severity increases with prior offenses or aggravating circumstances.
- Post-Conviction Requirements: To regain your license, you must complete DUI school, pay fees, and file SR-22 insurance. In some cases, you’ll also need to install an ignition interlock device (IID) in your car.

My son was wrongfully accused and charged with assault. I hired Mr. Humphrey to represent him because I heard he was the best and as my son is 19 years old, I did not want this bogus charge going on his record. Mr. Humphrey did an excellent job of representing my son from day one. I am happy to say that the charges were dropped and the case was dismissed. I HIGHLY recommend Kyle J. Humphrey.
